  1. The ICTHK.ORG website (the “Website”) is developed and managed by the Institute of Cognitive Therapy (“ICT”). You acknowledge and agree that if you decide to browse or use the services provided on the Website, you do so at your own risk.
    ICT shall not be liable for any loss or damage whatsoever arising out of or in connection with, or otherwise linked to, your access to or use of this website.

The information and content provided by ICT is based on and governed by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China, i.e. the information and content on this website may not be consistent with the needs and regulations of other jurisdictions or may not be appropriate to the circumstances in other jurisdictions.
  3. ICT undertakes to endeavour to ensure the accuracy and completeness of the contents of the Website, but accepts no responsibility for errors or omissions in the contents and accepts no liability for any loss or compensation in respect thereof.
  4. ICT may amend, alter or vary the Terms of Service and may discontinue them at any time without prior notice.
  5. Except for the content produced by ICT, any other content (including, but not limited to, information contained in the web pages and upload forms linked from this website is not ICT’s responsibility and therefore ICT shall not be liable for any damages arising from accidents (including infection by computer viruses), defamation, infringement of copyright or intellectual property rights. For the avoidance of doubt, any information, whether or not downloaded or obtained through the use of the services provided by ICT, is done at your own risk and discretion. Any damage to your computer system or corruption or loss of data as a result of the downloading of any information shall be your sole responsibility.

You acknowledge that you understand and agree that ICT shall not be liable for any direct, indirect, incidental, special, consequential exemplary or punitive damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, even if ICT has been advised of the possibility of such damages, arising out of

    • any data, information or message obtained directly from or through ICT; or
    • unauthorised access to or manipulation of your transmissions or data; and
    • any third party’s representations or behaviour as a result of the services provided by the Website; or
    • any other matters relating to the services provided by the Website.

 

Intellectual Property Rights.
  1. All content produced by or licensed to ICT on this website, including but not limited to all text, images, photographs, video, graphics, logos, icons, buttons, codes, software and programmes, and their compilation (meaning the collection, arrangement and assembly thereof), as well as all intellectual property rights therein, are the property of ICT in Hong Kong and are protected by Hong Kong and international copyright laws. All Content not posted, uploaded or otherwise placed on the Site by ICT is at all times subject to an irrevocable, non-exclusive licence in favour of ICT to use, reproduce, exploit or display such Content, in whole or in part, in connection with the operation of the Site. You must comply with all relevant laws and ensure that you have obtained a licence to use the Content on the Website. You will indemnify ICT against any loss suffered by ICT as a result of your failure to comply with such laws or to obtain such permission. 2.

Unless otherwise specified, no person shall copy, alter, reproduce, publish, upload, transmit or distribute in any manner or by any means any of the information and contents of this website without the prior written consent of ICT. Users are advised to contact us immediately if they become aware of any infringement of ICT’s copyright by any other person or organisation. 3.

Anyone who submits content (other than material placed on the Website by ICT (“ICT Material”)) and claims relating to that content (whether or not against ICT) accepts full responsibility for that content. Whilst ICT does not exercise editorial control over any Content posted by Users on the Website, ICT reserves the right to remove, at its sole discretion, any Content which it knows to be objectionable, whether or not the objection is substantiated, and to review, edit or delete any comments made by Users which it considers to be defamatory, unlawful, threatening or otherwise inappropriate. Notwithstanding the above, to the extent permitted by law, ICT shall not be responsible or liable for any content transmitted by third parties through this website.
  4. Subject to the above and other terms and conditions contained in this website, persons who have access to this website are authorised to use this website for any lawful purpose. The following is a non-exhaustive list of expressly prohibited uses.
    • Use of the Website to commit or promote illegal acts, including illegal copying of copyrighted material.
    • Misrepresenting the identity or authority of a user; or
    • Release viruses or other devices of any kind intended to cause interference with, loss or damage to any information available on or through this website, or to any system used for the operation of, or accessed through, this website.

    • Accessing or attempting to access another user’s account.
    • Trespassing or attempting to trespass on any part of the Site or any system operating the Site or any system accessible through the Site.
    • interfering with the exchange of communications in the Interactive Areas; and
    • store personal data obtained from this website unless expressly authorised by other terms and conditions of this website; and
      • Publishing: i. Content that infringes on intellectual property rights; ii.
      • post content that infringes on intellectual property rights; ii. post content that constitutes an offence to other persons or organisations
      • content that is defamatory or threatening to other people or organisations; iii. content that is offensive, obscene or indecent; iv. content that is not appropriate for the purposes of the Website
      • content that is offensive, obscene or hateful, or content that other users of ICT are likely to find offensive, obscene or hateful.

Anyone browsing or accessing this website is prohibited from engaging in any activity that violates intellectual property laws or infringes or causes infringement of the intellectual property and/or other proprietary rights of any material on this website and agrees that he/she will not link any part of this website to any website where such infringing activity may take place. Such infringing activities include
    • Infringement of any party’s copyright, trade mark, patent or other intellectual property rights or proprietary rights (“Intellectual Property Rights”).
    • Breach of any measures to protect the Intellectual Property Rights, including altering serial or registration numbers, or the use of hacking tools.
    • Copying, extracting or exploiting in any way the content of another person’s website without that person’s authorisation or consent.
    • Providing pirated files or links to such files.
  6. If a user is found to be engaging in activities that infringe intellectual property rights, ICT reserves the right, without notice and without incurring any liability or recourse against you, to
    • remove any content or information which it considers to be infringing or otherwise in breach of all intellectual property laws of the Hong Kong Special Administrative Region of the People’s Republic of China (“HKSAR”) (“IP Laws”), intellectual property rights; and
    • terminate the User’s relevant registration or account and consider taking appropriate legal action.
  7. All users agree and accept that ICT has the right of first refusal to use any web page or storage space provided or allocated by ICT (“Space”).
  8. All Users agree and accept that they will not (and they do not have the right to) sell, transfer, assign, relinquish or otherwise share or permit the use of all or any portion of the Space with others except with the prior consent of ICT. Users may not, directly or indirectly, derive or receive commercial gain from the use or exploitation of the Space or, in general, from this Website which ICT, in its sole discretion, considers to be material.
  9. All users agree and accept that they are not allowed to upload, post or disseminate on this website any content or information which is in contravention of or violates any laws, ordinances or regulations currently in force in Hong Kong (“Public Dissemination Laws”), including but not limited to: a. any programmes or files with computer viruses; or
    • any programme or file containing computer viruses; or
    • speech or material that is discriminatory on the basis of gender, age, sexual orientation, race, culture, religion, socio-economic status or otherwise; and
    • Contain content that is prejudicial, discriminatory, hateful, offensive, derogatory or profane to any person or organisation.
    • Images or contents containing pornographic and obscene materials, or any other contents in violation of the Control of Obscene and Indecent Articles Ordinance (COIAO), Section 390 of the Laws of Hong Kong.
    • Provision of material which contains or promotes illegal activities or which adversely affects any person or the public, including but not limited to
      • Providing computer virus software or methods of designing or writing computer viruses; ii.
      • providing a means of unauthorised access to, or deletion from, a web site or the web site of an Internet service provider
      • providing methods of decoding or copyright protection designs created by cracking manufacturers, including software serial numbers or registration numbers; iv. providing “spam” e-mail; v. providing “junk” e-mail; vi. providing “spam” e-mail.
      • providing methods of sending “junk” mail or making available to the public any software that can be used to crack software.
      • Providing pirated music, pirated software or links to related websites.
      • maliciously distributing or disseminating other people’s privacy, and requesting passwords from other members of the public or users of the Shared House.
      • hosting the Crush website; and
      • collecting information on this website for illegal purposes; and
      • impersonating or pretending to be an ICT staff member, or attempting to cause others to misinterpret the sender’s identity or the source of the message or information.
  10. If a user is found to have breached the law of public communication, with or without knowledge, we may, without liability or recourse to you: a. Remove any material that we consider to be in breach of the law of public communication; b. Remove any material that we consider to be in breach of the law of public communication; c. Remove any material that we consider to be in breach of the law of public communication
    • Remove any posting, content or material that we believe violates public communication laws or other laws, or the Terms; or
    • Terminate the user’s registration or account or consider taking appropriate legal action.
